Terms of service
The rules for using ColdDart, including who is responsible for contacting your leads lawfully.
1. What ColdDart is
ColdDart is a tool that writes a short opening line for each lead in a list you upload. You review the lines, edit them, and export them or push them to another tool. ColdDart does not send email on your behalf. These terms apply to the early-access service offered by Mazacode LTDA, CNPJ 45.655.559/0001-98, Florianópolis/SC (“we”).
2. Early access
The service is offered by invitation. Features, limits and prices can change. Prices and credit amounts are agreed with you before you pay.
3. You are responsible for contacting your leads lawfully
You must have a lawful basis to contact every person on a list you upload and to process their data. Cold outreach is regulated, and the rules differ by country and by type of recipient. Examples are CAN-SPAM in the United States, GDPR and the ePrivacy rules in Europe and the UK, and LGPD in Brazil. Where a rule requires consent, an opt-out, an unsubscribe link, a postal address or a record of where you got the contact, you are the one who must meet it.
ColdDart does not check your lists, does not check whether a person may be contacted, and does not make an outreach campaign compliant. Nothing on this site or in the product is legal advice. If you are unsure, ask a lawyer in the country of your recipients.
4. Acceptable use
Do not use ColdDart to deceive recipients, to impersonate someone, to send unlawful or abusive messages, or to process data you have no right to process. We can suspend an account that breaks this section.
5. AI output
Lines are written by a language model and can be wrong, awkward or too generic. Read every line before you send it. You are responsible for what you send. ColdDart does not promise that a line is accurate, that it will be opened or answered, or that any message reaches an inbox.
6. Your data
You keep your data. You give us permission to process it to provide the service, as described on the privacy page. You confirm that you may upload the lists you upload.
7. Credits and payment
One lead uses one credit. A credit is reserved when a job starts and refunded when the line fails. Credits and prices are agreed before purchase. Taxes are your responsibility where they apply.
8. No guarantee of results
We make no promise about replies, meetings, revenue or deliverability. The service is provided as it is during early access, and can be unavailable or change without notice.
9. Liability
To the extent the law allows, our total liability for any claim about the service is limited to the amount you paid us in the three months before the claim, and we are not liable for indirect or lost-profit losses. This section does not limit liability that the law does not allow to be limited.
10. Ending the relationship
You can stop using the service and delete your account at any time. We can end access for a breach of these terms. Sections that by their nature continue (data, liability, jurisdiction) continue.
11. Law and courts
Brazilian law applies. Disputes go to the courts of Florianópolis, Santa Catarina, Brazil, unless mandatory consumer law gives you another venue.
